Accepting these terms

By opening any page on this website you agree to these terms and to our Privacy Policy. If you do not agree with them, please do not use the site. Nothing else is asked of you, since there is no account to create and no box to tick.

If you use the site on behalf of someone else, a parent arranging care for a child for example, you accept these terms for yourself and for that person.

These terms apply to the website. They do not replace the consent forms, financial agreements and other paperwork you sign as a patient of the practice, and they do not replace our Notice of Privacy Practices, which governs your dental record.

No dentist and patient relationship

Reading this site, sending us a message, submitting the appointment request form, or calling to ask a general question does not create a dentist and patient relationship. That relationship begins only after you have been seen at our office and formally accepted for care.

Until then we cannot advise you on your own situation, and anything we say in reply to a general question is general information rather than treatment advice.

Sending an appointment request does not confirm an appointment. An appointment exists once a member of our team has spoken with you and confirmed a date and time.

Individual results vary

Any result described on this site reflects one patient's circumstances. It is not a promise, a guarantee or a prediction of what your own treatment will achieve.

Outcomes depend on the condition of your teeth and gums, your bite, your medical history, how a case is planned and what you are able to maintain afterward. Where before and after photographs appear, they show a single case and are not a representation that a similar result is typical.

No dentist can guarantee the outcome of treatment, and nothing on this site should be read as doing so.

How you may use the site

You may read this site, print or save pages for your own reference, and share links to it. That is what it is here for.

The site is intended for visitors in the United States. The practice provides dental care only in California, where Dr. Robert J. Brosi, DDS is licensed by the Dental Board of California under license number 029875. We make no representation that the content is appropriate or available for use anywhere else, and if you use the site from another place you are responsible for complying with local law.

The site is not directed to children under thirteen, and we ask that children do not send us information through it.

Content ownership

The text, photographs, illustrations, page design, code and arrangement of this site are owned by Robert J. Brosi, DDS Inc. or used with permission, and are protected by United States copyright and trademark law.

Nothing on this site grants you a license to use our name, our logo or our content, except that you may print or save pages for your own personal, non-commercial reference with any notices left intact.

Third-party names, trademarks and product names mentioned on this site, including Invisalign and CareCredit, belong to their respective owners. They appear only to describe services and payment options available to our patients, and they do not imply any endorsement of this practice by those owners.

If you believe material on this site infringes your copyright, write to us at the address at the end of this page with enough detail to identify the work and the page it appears on, and we will look into it.

Links to other websites

This site links to other organizations, among them professional associations, a map provider, a form provider and health information published by government agencies. Those sites are not under our control.

A link is not an endorsement of everything on the site it points to. We are not responsible for the content, accuracy, availability or privacy practices of any site we link to. Once you follow a link away from here, the terms and the privacy policy of that other site apply, and it is worth reading them.

The two features on this site that load from another company are described in our Privacy Policy, and neither loads until you allow it.

Availability and no warranties

We try to keep this site accurate and available, and we correct mistakes when we find them. We cannot promise that it will always be available, that it will be free of errors, or that any particular page is complete or current. Dentistry moves, and a page written today may be out of date tomorrow.

The site and its content are provided as they are and as available, without warranties of any kind, whether express or implied. To the fullest extent permitted by law the practice disclaims the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the site will be uninterrupted, secure or free of viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Robert J. Brosi, DDS Inc. and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or business interruption, arising out of or connected with your use of this website or your inability to use it, whether the claim is based on contract, warranty, negligence, strict liability or any other theory, and even if we were told such damages were possible.

Where liability cannot be excluded, our total liability to you for all claims connected with this website is limited to one hundred United States dollars.

This section is about the website. It does not limit our responsibility for the dental care we actually provide to our patients, and nothing in these terms is intended to limit any liability that cannot be limited under California law, including liability for professional negligence, for fraud, or for personal injury caused by our negligence or willful misconduct.

Some jurisdictions do not allow the limitation of liability for certain damages, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Robert J. Brosi, DDS Inc. and its owners, employees and contractors from any claim, loss, liability or reasonable attorney fee arising out of your use of this website in breach of these terms, your violation of any law, or your infringement of another person's rights.

We will tell you promptly about any claim covered by this section and will cooperate with you in defending it, and you will not settle any such claim in a way that imposes an obligation on us without our written consent.

Governing law and where disputes are heard

These terms, and any dispute arising out of them or out of your use of this website, are governed by the laws of the State of California, without regard to its conflict of law rules.

You and the practice agree that the state and federal courts located in Madera County, California have exclusive jurisdiction over any such dispute, and each of us consents to venue there. If you are a consumer, this does not take away any right you may have to bring a claim in small claims court, or any protection given to you by the law of the place where you live that cannot be overridden by agreement.

These terms contain no arbitration clause, no class action waiver and no waiver of a jury trial.

If part of these terms cannot be enforced

If a court decides that any part of these terms cannot be enforced, that part will be limited or removed to the smallest extent necessary and the rest will stay in force.

If we do not enforce a provision on one occasion, that is not a waiver of it on any other occasion. These terms, together with our Privacy Policy, are the entire agreement between you and the practice about your use of this website.

You may not transfer your rights or obligations under these terms to anyone else. We may transfer ours if the practice is sold or transferred to another dentist.

Changes to these terms

We may update these terms. The effective date at the top of this page tells you which version you are reading, and the current version is always the one posted here.

Continuing to use the site after a change means the updated terms apply to your use of it. If you do not agree with a change, stop using the site.
